General Terms and Conditions for Donations to GRACE


GRACE (Global Resilience Alliance for Community Emergencies) is a Ghanaian-based nonprofit organization dedicated to empowering communities and building resilience during emergencies and disasters. GRACE provides an online fundraising platform to connect donors—individuals or organizations—with initiatives designed to address critical community needs. These Terms and Conditions (“T&Cs”) govern all online services that facilitate donations to GRACE initiatives. The platform can be accessed through GRACE’s website and affiliated digital channels, including social media. Donations are processed by payment partners who act as intermediaries to ensure secure and efficient transactions.

Acceptance of Terms

By making a donation through any of GRACE’s fundraising tools, donors confirm that they have read and accepted these T&Cs, as well as any additional terms specific to the chosen fundraising tool.

Eligibility

To make a donation, donors must be at least 16 years of age.

Donation Process

When a donor clicks “Donate” or “Confirm Payment” on the fundraising platform, the donation process is finalized, and the specified amount is deducted from the donor’s account. Once the transaction is complete, a payment confirmation will be sent to the donor via email. Donations made as one-time contributions are non-revocable. However, monthly recurring donations, which provide sustained funding for GRACE’s initiatives, can be canceled for future payments, and the responsibility to terminate such donations rests with the donor.

Donation Amounts and Currency

Donations are denominated in United States Dollars (USD) but will be converted to Ghanaian Cedis (GHS) based on the prevailing exchange rate at the time of the transaction. Any transaction costs associated with currency conversion will be deducted from the donation amount.

Donation Retention and Fees

GRACE retains 20% of the total donation amount to cover administrative and operational costs essential to supporting its initiatives. Additionally, payment processors may apply service charges, and donors may choose to cover these fees on top of their donations.

Donation Acceptance

GRACE reserves the right to conduct due diligence on all donations and may return contributions that are inconsistent with its policies or values.

Prohibited Donations

GRACE does not accept funds from individuals or entities associated with the arms or tobacco industries. Any contributions from such sources will be returned. For donations exceeding USD 50,000, donors must complete a disclosure agreement confirming compliance with GRACE’s gift acceptance policy.

Use of Donations

Donations will be directed toward the specific initiative chosen by the donor. If the selected initiative no longer requires funding, the donation will be redirected to GRACE’s “Where It Is Most Needed” fund, which addresses urgent areas of need. Annual impact reports detailing the allocation and use of funds will be made available to the public, ensuring transparency and accountability.

Tax Deductibility

GRACE does not guarantee tax deduction receipts for donations. Donors are encouraged to consult local tax regulations or financial advisors regarding potential deductions.

Responsibility and Liability

GRACE cannot be held responsible for issues or errors arising from third-party payment processors or other intermediaries. Once funds are allocated to partners or organizations for implementation, GRACE disclaims responsibility for their use beyond the agreed purposes. Donors are responsible for providing accurate information during the donation process, and GRACE assumes no liability for inaccuracies or omissions.

Data Privacy

GRACE is committed to protecting donor privacy and processes all personal data in accordance with its Data Protection Policy. Details on how data is managed can be found in GRACE’s Data Privacy Policy.

Force Majeure

GRACE is not liable for disruptions or delays caused by events beyond its control, such as natural disasters, political unrest, or global emergencies. In such circumstances, GRACE may suspend its obligations temporarily or modify operations as necessary.

Amendments

GRACE reserves the right to amend these T&Cs at any time. Updates will be communicated through the GRACE website or other official communication channels.

Governing Law and Jurisdiction

These T&Cs are governed by the laws of Ghana. Any disputes arising from these terms will fall under the exclusive jurisdiction of Ghanaian courts.
